Senior Partner William J. Sneckenberg and Associate James P. DuChateau were recently appointed as Special Counsel by Federal Bankruptcy Judge Manual Barbosa on behalf of the Trustee of a Bankruptcy Estate in the United States Bankruptcy Court for the Northern District of Illinois. The Federal Court has tasked Mr. Sneckenberg and Mr. DuChateau with pursuing, on behalf of the Trustee of the Bankruptcy Estate, pre-bankruptcy petition contractual and equitable rights of the Debtor in a commercial breach of contract action valued in excess of $325,000.00.

Associate James P. DuChateau recently achieved a unanimous arbitration award in favor of one of the firm’s clients, the former Senior Vice President of VSD Technologies, Inc., an Illinois-based network security and IT consulting firm. The Plaintiff, who was alleged to have been the financial backer VSD Technologies, Inc., but constrained by both non-competition and non-solicitation agreements from his prior employer, attempted to recast executive compensation payroll as personal loans to members of VSD Technologies, Inc.’s senior management team. After presentation of party witnesses, as well as former employees of VSD Technologies, Inc., the three-member arbitration panel unanimously ruled in favor of the firm’s client, the Defendant.

The firm’s founding partner and Omaha native, William J. Sneckenberg, was noted in the most recent issue of “The Nebraska Lawyer,” the official publication of the Nebraska State Bar Association. Bill was noted for activating his license to practice law in Nebraska and his status as a Trial and Appellate Specialist with a diverse civil litigation practice. After graduating from the University of Nebraska at Omaha and Creighton University School of Law, cum laude, Bill passed the Nebraska and Illinois bar exams and began practicing law in Chicago, Illinois. Since founding his own firm in 1982, the firm has evolved into the present-day Sneckenberg, Thompson & Brody, LLP with a rapidly expanding civil litigation practice in various midwestern states, including Illinois, Iowa, Missouri, Indiana, Kansas, and Nebraska. On Wednesday, March 14, 2012, Senior Litigation Counsel Rick Strawbridge spoke before approximately 80 individuals at a meeting of the regional Fire Investigators Strike Force (FISF); this is a multi-county organization of fire investigators from municipal and other governmental entities, as well as private investigators and private practice fire investigators. Rick spoke on the topic of “Giving a deposition: lawyers’ deposition objectives and tactics” and provided valuable insight to investigators on how to work in concert with lawyers’ goals and strategy for litigation matters.

Emilie G. Kaplan Settles Subrogation Claim Against Distributor of Aquarium Chillers

Senior Associate Emilie G. Kaplan recently achieved a large pre-suit settlement of a subrogation claim against the U.S.- based distributor of an aquarium chiller that was claimed to have overheated and caused a fire resulting in over $150,000.00 in property damage. The Asia – based manufacturer of the chiller could not be pursued due to jurisdictional hurdles, yet Ms. Kaplan successfully pursued the chiller’s distributor.
