Mr. Brody recovered 85% of the client’s subrogated damages in a negotiated settlement with a third party that caused serious damage to property insured by the Firm’s client! Attorney Emilie G. Kaplan Promoted to Senior Associate

The Firm announces that attorney Emilie G. Kaplan has been promoted to the position of Senior Associate. Ms. Kaplan has been associated with the firm since 2006, when she was a Summer Associate. She joined the firm as an attorney following her admittance to the Illinois Bar in November 2007. Since that time, Ms. Kaplan has gained significant litigation experience and responsibility in the Firm’s practice areas of insurance subrogation and defense, as well as insurance coverage, personal injury and general commercial litigation. Firm persuades Michigan Court of Appeals to allow family victimized by gas explosion which destroyed their home to pursue case against a contractor and a gas company who allegedly fixed preexisting gas leak.

Today, The Wall Street Journal discussed “Alternative Litigation Funding” creating investment funds to invest in a case in exchange for a share of lawsuit winnings. The Firm believes that the practice has benefits to underfunded parties in leveling the playing field, but it is subject to serious potential abuses. The ABA should address this issue.
