ESTABLISHMENT OF LEGAL PRECEDENTS

The following are examples of the many legal precedents established by the firm on behalf of plaintiffs and defendants:

  • Over twenty-five published opinions from the Illinois and Appellate Courts, as well as numerous unpublished appellate decisions.

  • Established precedent for the standard of insureds in knowing and reviewing their own policies in Illinois. Furtak v. Moffett and Illinois Farmers Insurance Company, 284 Ill.App.3d 255, 671 N.E.2d 827, 219 Ill.Dec. 660 (1st Dist. 1996).

  • Represented Truck Insurance Exchange in successful trial and appellate decision upholding the jury verdict which specifically found the insured guilty of arson, false swearing, and refusal to cooperate with the insurer’s investigation of the claim. Kafka v. Truck Insurance Exchange, 19 F.3d 383 (7th Cir. 1994).

  • Established precedent for creating defense of fraud as a matter of law in Illinois fire cases. Folk v. National Ben Franklin Ins. Co., 350 N.E.2d 1056 (1976).

  • Established precedent for finding insured involvement in arson and fraud based upon circumstantial evidence. Moore v. Farmers Ins. Exchange, 444 N.E.2d 220 (1982).

  • Represented University of Illinois in successful trial and appellate decision involving claims of age discrimination by rejected medical school applicant. Cannon v. The University of Health Sciences, 710 F.2d 351 (7th Cir. 1983).


OTHER SIGNIFICANT ACHIEVEMENTS

  • Defended subrogation suit seeking $12 million in damages for explosion which destroyed office building, resulting in settlement for nuisance value.

  • Prosecuted lawsuit against large insurance company who denied the claim on the basis of fraud. Jury awarded 100% of amount demanded, the full policy limit.

  • Defended apartment complex on slip and fall case where the plaintiff argued they were permanently injured as a result of defective condition created by the complex. Settled the case for less than the cost of defense on the eve of trial, and created new law on the doctrine of open and obvious in the process.

  • Defended insurance client on coverage issues where the insured argued it was entitled to approximately $3.5 million in damages under certain policy coverages. We argued to jury that the insured was due less than $100,000.00 in covered losses. Jury awarded $65,000.00.

  • Prosecuted a wrongful discharge matter. Asked jury for $150,000.00. Jury awarded $250,000.00.

  • Defended insurance client in suit seeking $250,000 limit of underinsured motorist policy; won summary judgment based on insured’s refusal to furnish financial records and cooperate in the claim investigation.

  • Defended public adjuster in malpractice action by insured medical clinic seeking $2.5 million in damages arising from arson fire to clinic; won summary judgment vindicating client of all liability.

  • Prosecuted a subrogation matter for an insurance company with approximately $800,000.00 in damages. Settled the matter for $1,000,000.00– more than the insurance company paid their own insured.

  • Defended surety against claim for $23 million in damages due to misfeasance of insurance agent; settled for cost of defense.

  • Coordinated settlement for surety client involving over 40 subcontractors arising from default on performance bond; resulted in zero payment by surety and either payment or bar of all contractors’ claims.

  • Defended Puerto Rico-based boiler and machinery carrier against $2.8 million claim brought by insured for explosion of furnaces; settled for $150,000.00.
